Terms and conditions
Last updated:
These terms apply when you use demo.carentos.shuva.design and when you rent a car from [company name] after a request sent through the site, by phone or in a message. Please read them before you send a request: by sending one, you accept them.
The rental itself is made under a written rental contract. These terms are part of it; where the contract says something different, the contract applies. Prices, fees and limits are on the Rental terms page and in our confirmation.
Who we are
[company name], tax ID (CUI) [tax number], Trade Register no. [registration number], registered office: [registered office].
Phone: +40 21 040 0123, email: hello@example.com.
We show these details as Law no. 365/2002 on electronic commerce requires; they are also at the bottom of every page.
Booking
- The form on the site is a request, not an order. Sending it costs nothing and does not create a contract.
- The site takes no payments: nothing is charged online.
- We reply by phone or in a message. We confirm the car, the dates, where you pick it up and return it, the price and the deposit, or offer another car or other dates if yours are not free. The booking is made when we confirm it and you agree.
- Prices on the site are per day and depend on the car and the length of the rental; the confirmation gives the total. If a price on the site is wrong, we tell you before we confirm, and you decide whether to book.
- Nothing is paid before you pick up the car.
The 14-day right of withdrawal from distance contracts does not apply to car rental for set dates (Government Emergency Ordinance no. 34/2014, art. 16 lit. l)). You can still cancel as described below.
Cancelling
- You can cancel by phone or in a message at any time before pick-up.
- Cancelling costs nothing up to pick-up.
- If we cannot provide the car (after an accident or a breakdown, for example), we offer a similar one or, if you don't want it, return everything you paid, in full.
Price, deposit and payment
- When and how you pay for the rental is stated in our confirmation.
- The deposit is €200–1,000, depending on the car; the confirmation gives the amount for yours and when and how you pay it.
- We return the deposit after the rental, keeping back only what you owe under the contract and what can be shown, such as damage the insurance does not cover, fines and other charges from the rental period that are yours under the contract, missing fuel, extra kilometres or cleaning, at the prices on the Rental terms page or in the contract. When it is returned is stated in the contract.
- You get a receipt or an invoice for every payment.
Driver and documents
- Minimum age of the driver: 21 years; for some cars, 25 years (the confirmation says if yours is one of them).
- Minimum time with a driving licence: 2 years.
- Bring the documents listed on the Rental terms page, among them a valid identity document and your driving licence. Where the law or that page requires it, you also need an International Driving Permit.
- Only the drivers named in the contract may drive the car. Additional drivers must meet the same requirements.
Fuel, mileage and travel abroad
- The car comes with a full tank and goes back with a full tank. Missing fuel is charged as stated on the Rental terms page or in the contract.
- Up to 300 km a day are included, unless the Rental terms page or the confirmation gives your rental another limit or none. Extra kilometres are charged at the price stated there.
- You may take the car abroad only within the European Union, if you tell us before pick-up; the conditions and any fee are on the Rental terms page.
- Don't drive under the influence of alcohol or drugs, and don't let anyone drive who is not named in the contract. Other limits on how the car may be used (racing, towing, subletting, carrying passengers or goods for money) are set in the contract.
- Tell us at once about any accident, damage, theft or warning light, and follow the local rules for reporting accidents to the police. Don't have the car repaired without our agreement.
Damage and liability
- We hand over the car in working order and insured: the compulsory motor third-party liability insurance (RCA). Its condition at handover is recorded as the contract provides.
- You are responsible for the car from pick-up until we take it back. Damage, loss or theft that you cause and that the insurance does not cover is yours to pay, within the limits of the contract and the law. What the insurance does not cover and any additional cover are on the Rental terms page or in the contract.
- Fines and parking charges from the rental period are yours. Who pays tolls and vignettes is set by the contract; any that the rental includes are named on the Rental terms page. If the authorities send a fine to us, we pass the amount on to you and, where the law requires it, give them your details as the driver.
- We are responsible for defects the car had at pick-up. If it breaks down through no fault of yours, tell us at once; a replacement car, or the price of the days you could not use it, is settled as the contract and the law provide.
- Nothing in these terms limits the rights the law gives you as a consumer.
Using the site
- The site helps you choose a car and send a request. Photos and specifications show the model; the car you get may differ in colour or equipment, and the confirmation names it.
- Send only true details, your own or with the person's consent; don't send automated requests or try to disrupt the site.
- The texts, photos and design of the site belong to us or are used with permission. Please don't copy them without asking.
- Links to other sites are there for convenience; we don't answer for their content.
Personal data
We use the details you send us with a request to answer it, to make and carry out the rental contract and to keep the records the law requires.
What we collect, why, for how long, who receives it and your rights are in the Privacy policy; cookies are explained in the Cookie policy. Questions about your data: hello@example.com.
Force majeure
Neither you nor we are liable for not keeping an obligation when force majeure prevents it: an event outside our control that could not be foreseen or avoided, such as a natural disaster, a fire, or a road or border closed by the authorities (Romanian Civil Code, art. 1351).
Whoever is affected tells the other as soon as possible. If the rental cannot take place because of it, either of us may cancel the booking without a fee, and we return what you paid for the days you could not use the car.
Complaints and disputes
If something is wrong, tell us first: call +40 21 040 0123, write to hello@example.com or write to our registered office. We look into every complaint and reply to you.
If we cannot agree, you can complain to the National Authority for Consumer Protection (ANPC), anpc.ro, or use alternative dispute resolution (SAL): reclamatiisal.anpc.ro. You can also go to court.
These terms and the rental contract are governed by Romanian law, in particular Government Ordinance no. 21/1992 on consumer protection, Government Emergency Ordinance no. 34/2014 on consumer rights and Law no. 365/2002 on electronic commerce. If you live in another country, this does not take away the protection its mandatory rules give you as a consumer.
Changes
We may update these terms; the date at the top shows the current version. A booking follows the version in force when we confirmed it.
Final provisions
We make the rental contract in one of the languages these terms are published in, the one we agree on with you when we confirm the booking.
These terms are published in English. If the versions differ, the English one prevails.
The site neither makes nor stores contracts: your request comes to us, and you get your copy of the signed rental contract.
If a provision of these terms is or becomes invalid, the others remain in force, and the rule the law provides applies in its place.
